1. Introduction
These Terms and Conditions (“Terms”) govern your use of the services, products, and platforms provided by MobiVex Pvt. Ltd. (“MobiVex,” “we,” “our,” or “us”). By accessing or using our website, applications, or any of our services, you agree to be bound by these Terms. If you do not agree with these Terms, you must discontinue use of our services immediately. These Terms apply to all customers, clients, partners, and visitors.

2. Eligibility and Account Responsibility
To use our services, you must be at least 18 years of age or have legal parental/guardian consent. You are responsible for maintaining the confidentiality of your account information, including login credentials. Mobivex will not be liable for any unauthorized access or misuse of your account due to your negligence. You agree to provide accurate and up-to-date information during registration and to notify us immediately of any changes.

3. Scope of Services
Mobivex provides IT solutions, software development, web and mobile applications, e-commerce platforms, and related services. All services are provided as per the agreed scope in contracts, proposals, or work orders. We reserve the right to modify, upgrade, or discontinue any service at our sole discretion, with reasonable prior notice where possible.

4. Payment Terms
All payments for our services must be made according to the pricing, milestones, and timelines mentioned in your agreement with Mobivex. Unless otherwise stated, payments are non-refundable. Any delay in payment may result in suspension or termination of services. We may charge interest on overdue amounts at the rate permitted by law until payment is received in full.

5. Intellectual Property Rights
Unless otherwise stated in a written agreement, all intellectual property created, developed, or delivered by Mobivex during a project remains the property of Mobivex until full payment is received. Upon completion and payment, ownership may be transferred to the client, subject to contractual terms. You agree not to copy, modify, or distribute our intellectual property without prior written consent.

6. Confidentiality
Both parties agree to maintain the confidentiality of all proprietary information, trade secrets, and project details shared during the course of the engagement. Neither party shall disclose such information to any third party without prior written consent, except where required by law. This confidentiality obligation survives the termination of the business relationship.

7. Limitation of Liability
Mobivex will not be liable for any indirect, incidental, or consequential damages arising from the use or inability to use our services. Our total liability for any claim related to our services will not exceed the total amount paid by the client for those specific services. We do not guarantee that our services will be error-free, uninterrupted, or immune from cyber-attacks.

8. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising from or related to these Terms shall be resolved through amicable negotiations. If unresolved, disputes shall be subject to the exclusive jurisdiction of the courts located in New Delhi, India. By using our services, you agree to submit to this jurisdiction.
